Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and DoSplit ("DoSplit", "we", "us", "our"), the operator of the DoSplit application and related web and API services (collectively, the "Service"). By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

DoSplit is operated from Chișinău, Moldova. For legal enquiries, contact [email protected].

2. Eligibility

You must be at least 13 years old (or, if higher in your country, the minimum age of digital consent — for example 16 in parts of the EEA and UK) to use the Service. If you are below the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed these Terms and accepted them on your behalf. The Service is not directed at children under 13 and we do not knowingly allow children to register.

3. Your Account

You may register using your email address, Apple ID, or Google account. You are responsible for the accuracy of the information you provide and for any activity that occurs under your credentials. Notify [email protected] immediately if you suspect unauthorised access. You may not transfer your account or share credentials. We may refuse, reclaim, or suspend any username at our discretion.

4. The Service

DoSplit lets you create groups, record shared expenses, settle balances between members, and (optionally) receive transactional email notifications such as settle-up alerts, expense updates, and a monthly group summary. Each email family can be turned off independently from Profile → Notification settings. The Service is provided as a utility for tracking shared expenses among friends, family, or colleagues.

IMPORTANT: DoSplit is not a bank, payment processor, lender, broker, money-services business, or financial adviser. We do not transmit funds and do not handle money on your behalf. Any actual transfer of money happens outside the Service through whatever method you choose. While we strive for accuracy, you remain responsible for verifying every amount before transferring money.

5. No Charge for Use

DoSplit is currently free to use. We do not charge for the Service, do not collect payment information, and do not run ads or sell your data to make money.

We may introduce paid features in the future. If we do, we will present clear pricing and ask for your separate agreement before any charge — nothing in these Terms authorises us to bill you today.

6. Acceptable Use

You agree not to:

  • use the Service for any unlawful, fraudulent, defamatory, or harmful purpose;
  • access another user’s account or data without permission;
  • probe, scan, or test the vulnerability of the Service or violate authentication;
  • introduce malware, automated scrapers, or denial-of-service traffic;
  • reverse-engineer, decompile, or attempt to derive source code from the Service except where local law expressly permits;
  • harass, threaten, or impersonate any person or entity.

We may investigate violations and take any action we consider appropriate, including suspending or terminating accounts.

7. Your Content

"Your Content" means anything you submit (group names, expense titles, member nicknames, photos, etc.). You retain all rights you have in Your Content. You grant DoSplit a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transmit, display, and process Your Content solely to provide and improve the Service.

You represent that you have the necessary rights and consents to submit Your Content and that it does not infringe anyone’s rights or violate any law.

8. Intellectual Property

The Service, its design, source code, branding, and the "DoSplit" name and logo are owned by DoSplit and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the Service in accordance with these Terms. All other rights are reserved.

9. Third-Party Services

The Service interoperates with third-party services, including Apple Sign In, Google Sign In, the App Store, Google Play, Amazon Web Services (email delivery), and Google Analytics / Firebase (analytics and crash reporting). Your use of those services is governed by their own terms and privacy policies; see our Privacy Policy §7 and §9 for the full list. We are not responsible for the availability, content, or actions of any third-party service.

10. Apple App Store / Google Play Additional Terms

Where you obtained the Service from the Apple App Store or Google Play:

  • These Terms are between you and DoSplit only — not Apple or Google.
  • Apple and Google have no obligation to provide maintenance or support for the Service.
  • Apple and Google are not responsible for any product warranties, claims, or third-party intellectual-property claims relating to the Service.
  • Apple and Google are third-party beneficiaries of these Terms with the right to enforce them against you.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms. The Privacy Policy explains what personal information we collect, how we use it, and the rights you have, including specific rights for California, EEA, and UK residents.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OF ANY CALCULATION, CURRENCY CONVERSION, OR DEBT SIMPLIFICATION; YOU ARE RESPONSIBLE FOR VERIFYING ALL AMOUNTS BEFORE TRANSFERRING MONEY.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our warranties are limited to the minimum extent permitted.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOSPLIT AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE — WHETHER IN CONTRACT, TORT, OR OTHERWISE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 50.

NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW (INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION).

14. Indemnification

You will indemnify and hold harmless DoSplit and its affiliates, officers, employees, and agents from any third-party claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your use of the Service in breach of these Terms or applicable law, (b) Your Content, or (c) your infringement of any third-party right.

15. Termination

You may stop using the Service at any time and delete your account from Profile → Delete Account. We may suspend or terminate your access to the Service at any time, with or without notice, for breach of these Terms or for activity we reasonably believe is harmful to other users, third parties, or us.

Upon termination, your right to use the Service ceases immediately. Sections 7–11 and 12–19 survive termination.

16. Governing Law and Disputes

Governing law. These Terms are governed by the laws of the Republic of Moldova, without regard to conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

Forum (default). Subject to the next paragraph, the courts of Chișinău, Moldova, have exclusive jurisdiction over any dispute arising out of these Terms.

Arbitration and class-action waiver (U.S. residents). If you reside in the United States, you and DoSplit agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual action in small-claims court. YOU AND DOSPLIT EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. You may opt out of this arbitration provision by emailing [email protected] within 30 days of first accepting these Terms; the rest of the Terms will remain in effect.

EEA / UK consumer rights. Nothing in this section affects the mandatory rights of consumers domiciled in the EEA or UK to bring proceedings in their local courts under applicable consumer-protection law.

17. Changes to These Terms

We may update these Terms. We will notify you of material changes by posting an updated version in the Service and updating the "Last updated" date. Changes take effect 14 days after posting. If you do not agree to the changes, stop using the Service before they take effect.

18. General

Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be enforced to the maximum extent permitted by law.

Entire agreement. These Terms (together with the Privacy Policy and any subscription terms presented at purchase) are the entire agreement between you and DoSplit and supersede prior agreements on the subject.

No waiver. Our failure to enforce any right is not a waiver of that right.

Assignment. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Notices. We give you notices through the Service, by email to your account address, or by posting in the App; you give us notices at [email protected].

Force majeure. Neither party is liable for failures caused by events beyond its reasonable control.
